Mortgage Assist Pro - Terms of Business (SaaS Monthly)
1. Introduction
These Terms of Business govern the use of Mortgage Assist Pro ("Service"), a cloud-based mortgage case-checking platform provided by Finssist Ltd ("we," "us," "our").
Finssist Ltd is a company registered in England and Wales under company number 15436286, with its registered office at Willow Brook, Withy Mills, Bristol, BS39 7PT.
By using our Service, you agree to comply with these Terms.
2. Regulatory Information
Finssist Ltd is not a financial advisor, mortgage lender, or regulated entity. Mortgage Assist Pro is a technology-based tool designed to support mortgage professionals in case-checking but does not provide financial, legal, or regulatory advice.
3. Service Scope & Usage
- Subscription-based, non-transferable SaaS license for internal business use.
- Users may not sublicense, resell, or share login credentials.
- The Service provides automated mortgage case checks.
- We do not provide financial or legal advice; all outputs should be reviewed by a qualified professional.
4. Eligibility & Right to Refuse Service
- The Service is intended for individual mortgage professionals and financial services firms.
- We reserve the right to deny, suspend, or revoke access at our discretion.
- Termination may occur if usage conflicts with our business model, ethics, or security policies.
5. Subscription, Billing & Cancellation
- Subscriptions are auto renewed monthly and payable in advance.
- Upgrades and downgrades take effect immediately upon payment.
- No refunds for monthly subscriptions after the billing cycle starts.
- 7-day grace period for overdue payments before suspension.
6. Data Protection, Security & Compliance
As of 28.02.2025, all client data is securely stored on AWS UK-based servers (AWS London, eu-west-2 region).
- Data is processed and stored exclusively in the UK.
- No data transfer outside the UK unless explicitly requested by the client.
- GDPR compliance without reliance on Standard Contractual Clauses (SCCs).
- Data encryption with AES-256 for storage and TLS 1.2 for transmission.
7. Service Availability, Maintenance & SLA
- 99.5% uptime annually.
- Service credits available if uptime falls below 95% (excluding scheduled maintenance).
- 48-hour notice for maintenance, except in emergencies.
8. Third-Party Integrations & Liability
- Integration with third-party mortgage CRM systems.
- We are not responsible for third-party reliability, security, or privacy practices.
- Users authorize data processing and transmission to connected third-party applications.
9. Limitation of Liability & AI-Specific Limitations
- AI-generated outputs may contain errors, biases, or inaccuracies.
- The Service does not replace human judgment or professional advice.
- Users must independently verify AI-generated results before making decisions.
- Finssist Ltd is not liable for financial losses or regulatory penalties due to AI-generated inaccuracies.
10. Termination & Data Retention
- Users may cancel at any time via account settings.
- Data is retained for 30 days post-termination before permanent deletion.
- Accounts may be terminated with 30 days' notice for violations.
11. Changes to These Terms
- We may update these Terms with 30 days’ notice.
- Continued use after updates implies acceptance of changes.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.
